This Privacy Commitment is applicable to personal information and sensitive personal data or information, including information that is of a confidential nature (“Customer Information”) belonging to the customers, potential customers, and other users of the Services (“Customer(s)” or “you”) of www.rupyafin.com (HHMA Innovations Bharat Pvt Ltd.), its affiliates and group companies (collectively “RUPYAFIN”, “we”, “our”, or “us”). By accessing or using the Services, you confirm that you have read, understood, and unconditionally accepted this Agreement. If you don't agree, please stop using the Services and terminate your account immediately.

This Privacy Policy (the “Policy”) applies to the use of or access (including products and services being rendered herein) to the website www.rupyafin.com and it’s RUPYAFIN mobile/web application (hereinafter collectively referred to as the “Platform”), by the User (hereinafter “you” or “your”). This Privacy Policy governs RUPYAFIN's handling of Personally Identifiable Information and Sensitive Personal Data or Information collected from users of our Services, Website, and Apps. RUPYAFIN may collect, receive, possess, store, use, deal, handle, transfer, retain, and process Customer Information. This Privacy Policy explains RUPYAFIN’s collection, use, and protection of your personal information and sensitive personal data. We are committed to maintaining confidentiality and security of your personal information in accordance with applicable laws and regulations. By using our Services, Website, or Apps, you consent to the collection, use, and processing of your personal information as described in this Privacy Policy.

This Platform is provided by HHMA Innovations Bharat Private Limited (hereinafter “Company” or “RUPYAFIN” “RupyaFin”; “Rupyafin” or else in font and style or manner) or “our” or “we” or “us”), a company incorporated under the Companies Act, 2013, having its registered office at Ekdant Appartment, Near Mount Carmel School, Mul Road, Chandrapur – 442401, Maharashtra, India; and its corporate office at Ekdant Appartment, Near Mount Carmel School, Mul Road, Chandrapur – 442401, Maharashtra, India. RUPYAFIN is an digital platform with website, web and mobile application, software as per SaaS (software as a service) and Company or RUPYAFIN  is not regulated or authorised by any of the Government Department or Authorities or Regulatory Body. Rupyafin provides functionality on the Digital Platform which allows User(s) to connect and transact with Professionals (existing and registered with us) for Tax and allied services including investment products and is not to be construed as an Advisory or Executor Service on its own.

RUPYAFIN provides technology Platform namely www.rupyafin.com, and web/mobile application (collectively referred to as “Platform”) to You (User) and its registered (registered means registered with rupyafin, assigned or dedicated) Affiliates, Partners, Channel Partners, Strategic Partners, third party service providers, Business Associate or Agent including their sub-associates, employees and accountants (hereinafter be called as “Professional”). A Professional may also be another user on our Platform apart from Client (hosted on) or (user of) www.rupyafin.com and are shown under login of Client under My Professional.

"Users" : User for our platform means “Client(s) or Customer(s) or Consumer(s)” any person (either individual, association, firm or entity) who get themselves registered with www.rupyafin.com; with intent to view, review, utilize, consume, access, avail, etc. our products and services listed on our platform. As a user ("User" or "you") of the Platform, you hereby acknowledge that the Company solely operates as a technology platform, facilitating connections between you and various partners, including dedicated Professionals, financial institutions, data partners, Strategic Partners, and service providers. The Company's platform does not provide advisory or executor services, and its offerings do not constitute investment or banking advice or recommendations. This term "Professional" also includes listings of the Profile/ details of the Professional(s), including the services/Advisory that such Professional may offer / willing to offer to the users. "Service" : Service for our Platform includes all products and services listed on our website and domain including but not limited to taxation, investments, banking, offers, Tutorials, webinars, call-conferences, etc; means all services as enumerated under any icon.

Customer Information includes, without limitation, the following categories of personal data/sensitive personal data that we may collect, share, receive, possess, store, use, deal, handle, transfer, and otherwise process as per applicable laws:

 

(i)  FINANCIAL DATA

This includes, without limitation, information related to your financial situation, comprising:- Bank account details (account numbers, statements); Financial data (income, expenses, assets); Financial documents (invoices, receipts, contracts); Financial records (ledgers, journals, balance sheets); Property statements (ownership documents, valuations); Payment information (credit card numbers, payment schedules); Transaction data (purchase history, sales records); Vouchers (receipts, invoices, bills); Tax-related documents (FORM 15CA, FORM 16, FORM 26AS, tax payment challans); Details of tax payments and expenses. This information is used to manage documents required for filing various tax returns and compliances, including ancillary services (activities) such as:- Registering you on relevant portals (Income Tax Department, GSTN, RERA, etc.); Preparing and filing tax returns; Providing supporting documents (ITR-acknowledgements, 26AS, registration certificates, return filing copies, income computation drafts).

 

(ii)  EASY MANAGEMENT OF DOCUMENTS

To utilize our Document Management Portal (www.rupyafin.com) for tax and/or allied services, we require a copy of relevant documents and correspondence from the applicable agency, as well as pertinent information. This data is collected to:

(i)  enable our professionals to draft and file responses to notices on behalf of clients;

(ii) facilitate seamless communication with clients;

(iii) provide acknowledgments and related documents to clients (Users) for easy access;

(iv) maintain accurate financial records;

(v) correspond with users, beneficiaries, and claimants for tax counseling and planning services;

(vi) offer various banking and investment products and services listed on the platform;

(vii) facilitate professionals in collecting information, data, documents, and invoices directly from clients. This data collection is essential for: (a) performing contracts with users or taking steps towards forming a contract; (b) providing all types of products and services listed on our platform;

(vii) Professional shown into Client’s login under “My Professional” tab, they may be duly assigned by RUPYAFIN or had been added by Respective Professional into the platform or had been self-registered under such Professional; of which Client has to take care and make his own due diligence before proceeding in very first time; while dealing with, before and in due of course of availing of services under the banner of www.rupyafin.com and or by using our web/ Mobile Application. In order to abstain from such on boarding, user has the right to report it to legal@rupyafin.com within 7 days of such onboarding.  (vii) Company reserves the right to change the Professional Assigned from time to time and any client, requests, leads or tasks be transferred to whom so ever the we feels fit in order to get the task or requests raised by customer being completed.  (viii) HHMA Innovations Bharat Pvt Ltd or RUPYAFIN or www.rupyafin.com does not takes any responsibility for delivering of any services or any issues arising of availing of services via using our platform; the sole responsibility lies on User to perform due diligence and to make sure before using any of the services. (ix) No liability will be considered in any case for any loss, damage, problems, scrutiny, mistakes, errors, human error, digital error, default, fault, faulty, emission, omission, addition, deletion, pendencies, pending, non-compliance, non-inform, non-consultation, non-obeyance, non-dealing and non-availability of any of our SERVICES or Assignment of Professional, etc. in any case and in any due course of time on RUPYAFIN (the company).

 

(iii)  OPERATIONAL DISCLOSURE

We, as the Platform Provider, hereby establish and operate the online infrastructure for the flow of information, communication, data, tasks, and documentation, and transmit the output file to the Platform-designated server, utilizing our databases, which are completely accessed and managed by our authorized Technology Service Provider. RUPYAFIN, in its capacity as a technology facilitator, merely enables connections between users and Professionals, without assuming any liability or responsibility for their interactions. HHMA Innovations Bharat Pvt Ltd (HHMA)'s role is strictly limited to providing Platform Services, (which are accessed and managed by our Technology Partner(s), pursuant to our agreement with them). Our Technology Service Provider is legally bound to maintain the confidentiality and privacy of all user data, and shall utilize their access solely for the purpose of maintaining, testing, and resolving technical issues, and managing the platform efficiently, in accordance with applicable laws, regulations, and industry standards. By using our platform, users consent to the terms of this agreement, and acknowledge that our Technology Service Provider shall have full access to the systems, as necessary, to provide efficient and secure services.

 

We also collect data in a de-identified form, which does not permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose so that we can better understand customer behaviour and improve our products, services, and advertising. The User may also avail services of Rupyafin, in order to search for their professional and get their work/tasks done from their professional through their respective login and connect with them. You authorise us to Add you as a Client in order to be a client of our Digital Platform and avail the services.

WE DO NOT PROVIDE ANY UTILITY OR SOFTWARE SERVICES FOR FILING OR PROCESSING ANY RETURN OR COMPLIANCES. PROFESSIONAL IS FREE TO USE THEIR OWN RESOURCES OR THEIR OWN UTILITY WHICHEVER THEY i.e. PROFESSIONALS HAVE. RUPYAFIN IS ONLY ACTING AS A TECHNOLOGY FACILITATOR TO USER(S) AND PROFESSIONAL(S) WHEREIN THE ROLE OF RUPYAFIN IS LIMITED TO THE EXTENT OF PROVIDING THE DIGITAL PLATFORM TO THE PROFESSIONAL AND THEIR RESPECTIVE EMPLOYEES (OR AFFILIATES) TO CONNECT, COMMUNICATE, STORE, TRANSFER AND DELIVER THE INFORMATION.

This Privacy Policy are governed by and construed in accordance with the provisions of Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and Rule 4 of the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal data or Information) Rules, 2011 framed under the (Indian) Information Technology Act, 2000 (as amended from time to time) and that requires publishing the privacy policy for usage of Platform and Services. This Privacy Policy read with the Terms of Use www.rupyafin.com/Legal/Terms (hereinafter the “Terms”); constitute a binding and legally enforceable contract between the Company and User.

For the purpose of this Privacy Policy, "Personal Information" is defined as any information that meets the criteria set forth in Section 3 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2013. This includes, but is not limited to, passwords, financial information such as bank account, credit card, debit card, or other payment instrument details, physical, physiological, and mental health conditions, sexual orientation, medical records and history, biometric information, and any details related to the aforementioned clauses provided to a body corporate for the purpose of providing services. Additionally, any information received under the aforementioned clauses by a body corporate for processing, storage, or processing under a lawful contract or otherwise is also considered Personal Information.

By accessing or using our Platform or Services, you hereby acknowledge that you have read, understood, and agreed to be bound by the terms of this Policy and our Terms of Service, as amended from time to time. If you do not agree to the terms of this Policy and our Terms of Service, please do not access or use our Platform or Services. You hereby warrant that you are either the owner of or are duly authorized to use and share the information required to provide our services, and that your use of the Platform does not violate any applicable law or contract by which you may be bound or is otherwise prejudicial to any person. You hereby agree to indemnify and hold harmless the Company, its employees, directors, officers, agents, business associates, Professional, Professional's Associates, affiliates, and agents from any loss, damage, expenses, or other adverse consequences they suffer as a result of your usage of the Platform and our services, unless such loss, damage, expenses, or other adverse consequences can be attributed to our act or omission. Your continued use of the Platform and Services shall constitute your acceptance of the terms of this Policy and our Terms of Service, as amended from time to time.

(iv)  PROTECTION OF PRIVACY

As a trustworthy financial services provider, we have implemented robust measures to prevent unauthorized individuals from accessing sensitive information by strictly prohibiting access to sensitive data, such as photos and contacts, from our users during activities to any unauthorised person. We recognize the paramount importance of safeguarding your personal information and prioritizing your privacy. Any data shared with our Partners is subject to their respective privacy policies and is handled as per the applicable laws and regulations.

Our Policy applies to all information collected, generated, or submitted through our Platform and Services, including but not limited to: (a) information you provide us, or the information otherwise collected by us through your usage of our Platform and Services (as defined in our Terms); (b) information collected while you use the Platform and Services; (c) information collected from any other source; or (d) information generated while availing the Services, including but not limited to any transactional information.

We guarantee utmost clarity regarding our data handling practices. If you decide not to share required information on our App/Site, certain services may not be accessible to you. Please note that our service provision is conditional upon receiving necessary information from you. By withholding information, you acknowledge that we bear no responsibility for any resulting service limitations. We hereby explicitly disclaim liability for such service restrictions.

In order to provide our services, we may transmit or share your information with our service providers, group companies, or business partners, as necessary from time to time. Additionally in context to above, with your prior consent, we may divulge your personal information to third parties.

This Policy should be read in consonance with the Terms (available at [https://rupyafin.com/Legal/Terms]) and they are incorporated by reference. Capitalized terms not defined here have the meaning given in the Terms of Service. Our Privacy Policy, incorporated herein by reference, explains how we collect, use, and disclose your information.

(v)  INFORMATION WE COLLECT

You must provide accurate, up-to-date, and true Customer Information. You're responsible for any errors or inaccuracies, except for verified KYC information. We require Customer Information to provide Services, fulfill contractual obligations, and comply with applicable law. If you do not wish to provide such Customer Information as and when requested by us, it will diminish our ability to perform our obligations under the arrangement we have with you or are trying to enter into with you (for example, to provide you with features of the Services). And consequently, we may be constrained to cancel or limit your access to the Services (or part thereof). This may include Customer Information you consent to give us when you use our Services or when you interact with us, including, without limitation, when you create an account with us and use the Services or carry out other activities in connection with the Services.

  1. When utilizing our Platform or Services, you consent to provide personal and sensitive information, including; Identification details (name, mobile number, address, password, date of birth, gender, PAN, Aadhar details, photograph, email ID) or copies of KYC documents that helps us confirm your identity; Financial information (bank account details, UPI ID, payment and investment information) which facilitate provision of the Services through our Platform; Professional and business information (occupation, educational/professional qualification, business name, address, registration details, GST details, schema). No liability pertaining to the authenticity/ genuineness of the information disclosed will lie on the Company; Tax identification numbers such as GSTIN, TAN, individual or firm details (their registration details from different authorities such as GST, MCA, registration details, etc.); Consent (by clicking); Interests.

Further, the Company will not be in any way responsible to verify any information obtained from you. We value your personal information and privacy. However, notwithstanding anything contained in this Privacy Policy or elsewhere, we shall not be held responsible for any loss, damage or misuse of Your Personal Information. We will not be responsible for liabilities arising out of computer hacking, system hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, or for any actions of any third parties that may receive your Personal Information.

  1. Wherever, required to provide your Aadhaar details to us during account creation, you acknowledge and agree that the act of providing your Aadhaar details to us is voluntary. We require Aadhaar details solely for the purpose of carrying out KYC and and for forwarding to Professional(s) or filing of tax returns or compliances related requirements by professional or as and when required related to the services being requested for by the USER.
  2. We collect and store the mobile numbers and email addresses you provide on our Platform, and use them to send you various communications, such as updates, notifications, and promotional materials.
  3. When you avail the Services, we will not be required to obtain consent, to access and read information from your logins such as information from your documents, bills, invoices, data, communications, messages, stored or being processed through our platform for providing our Services. Additionally, being platform felicitator every Service(s) requires us to obtain access and share/ forward to the ability to make forward the Leads, Tasks, Data, Information, Documents To the experts, Professional, Agents, concerned individual /Firm /Association /Company, etc. as the case may be, using or not using our platform(s). If you choose to avail such services, by agreeing to this Policy and Terms; you are providing your express consent to permit us to access and share the data, information, requests, leads, etc and functionalities of your logins. This is being done explicitly to deliver the requested services and quality.
  4. Pursuant to your use of our services, we may retrieve your information and records available with third party provider including credit score and liabilities information or information from the KYC Registration Agency, Goods and Services Tax Network (“GSTN”) and National Informatics Centre such as name, KYC details, KYC status, father’s name, occupation, address details and related documents. You hereby authorise the Company to download and retrieve any information from governmental and other statutory bodies including but not limited to GSTN and NIC.
  5. For various allied services such as in order to prepare your returns, to assist on your tax matters, to do compliances and/or to provide an audit defense service in relation to providing Tax solutions and forwarding of leads for the interested products and services for more information as requested by the user listed on our platform, Tutorials related services, conferences, webinars related, articles, blogs, books, Thesis, Products Listings, etc. (wherever required) we collect information about your income, deductions, credits, dependents, requirements, remarks, interests, likes, registration details and their respective photo copies, etc. collectively, this information is referred as “Tax Return Information”, Investment Related Information, Loans Related Information, Schemes Related information; etc. respectively to transfer leads or interests to the respective independent Expert or Professional to render the services to Client(s). We stands liability-free, obligations-free for any claims arising out of, any transactional activities performed outside the online domain of rupyafin.com related to or not related to the platform services.
  6. We may share with our affiliates, and group companies to the extent required for our internal business and/or administrative purposes and/or general corporate operations and to any third party service providers including marketing partners, and the User hereby consents to the same for the information (including personal information) collected. We will try to make sure to ensure that these third-party service providers are obligated to protect your personal information and are also subject to appropriate confidentiality/non-disclosure obligations and they comply with the applicable provisions of the data protection laws. These entities, with whom we share the Information, may market to you as a result of such sharing unless you explicitly opt-out; to enhance your experience and provide you access to the services being offered by us, our affiliates or other third party service providers (including but not limited to tech partners, lenders). Such disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing the Terms of Use or for complying with the applicable laws and regulations.

(vi)  HOW WE USE THE INFORMATION

Our platform employs robust security measures, including SSL certificates and HTTPS protocol encryption, to ensure the secure transmission of data between the server and device. Your OTP and password are strictly confidential and inaccessible to anyone except you. It is your responsibility to protect your device from unauthorized access. In the event of a data security breach or suspected compromise, you must promptly change your password and notify us at the contact details provided below. We are legally bound by the provisions of the Information Technology Act, 2000 and rules specified thereunder, and are obligated to maintain reasonable security measures and establish stringent security procedures to safeguard your data and information, as mandated by Section 43A of the Information Technology Act, 2000 (India).

  1. For the purpose of providing our services, we only share your personal, financial information or other information to the stakeholder, concerned party, related party, registered or unregistered party who is involved in the process of providing services in order to gain a value to the nature of services provided by our platform and in order to get your user services (leads/ tasks/CRM/Requests/process, etc) being availed or completed also, we do not sell or share your personal or financial information to anyone who is not a stakeholder. In order to support our operations we rely on several Service Providers, who help us with various services such as such as payment processing, web analytics, cloud hosting, marketing, communication, technical support, and other essential services, etc.

In compliance with Data Protection legislation and that the processing they carry out for us is limited to our specific purpose; whenever we share data with these Service Providers, we ensure, their usage, which is covered by a specific data processing contract. Notwithstanding any provisions in this Policy, you explicitly consent and agree to the following terms on information use, you hereby authorize us to access and utilize your information in the following manner:

  5. In order to deliver the service, we use services of third parties to provide the Platform and Services for you, who are bound to keep such information confidential and your information being shared to them.
  6. For enabling our technology service provider/ partners for troubleshoot software bugs and operational issues, to conduct data analysis, testing and research and to monitor and analyse usage and activity trends.
  7. For using the data in an aggregated/compiled form to produce statistical/demographic analyses for marketing, strategy and other business purposes. However, these will be used in ways that will not be able to identify you or link any specific information to an individual. Such aggregated information and results/analyses shall be our property and you will not be entitled to any compensation for the use thereof.
  8. For sharing your information with law enforcement, regulatory agencies, and other authorities as required by law to comply with legal obligations and regulatory requirements.
  9. Your usage data is summarized and combined with others to learn about the use of the Platform and Service usage, and to help us develop new products and services.

Your information, data or records may be used to manage, share or access your account except password in order to perform operations, improve and deliver our products and services on our platform. Additionally, you further acknowledge, agree and authorise us to use your information for including but not limited to, market research, compliances, delivering services, performing tasks, processing leads, product development, project planning, assisting in- providing tax solutions availing loans, availing schemes, availing government related policies/schemes, project planning and promotions, etc.
  11. We use your information to calculate charges for products and services you purchase.

On registering, to participate in an event published on our website, we may transfer your name, email address, phone numberand company name to our local organizer and to the sponsors of the event for both direct marketing purposes and in order to facilitate the preparations and booking for the event.
  13. On having expressed interest in using our services or otherwise asked to be contacted by our service provider, we may also transfer your name, email address, phone numberand company name to one of our official Partners (Professional, Strategic Partner or Affiliates) in your nearest region, for the purpose of contacting you to offer their local assistance and services.
  14. We may use your contact information to communicate with you in various ways (e.g. phone calls, messages, emails) for: Providing our Platform and Services; Marketing and promotional purposes. You hereby consent to receive communications from us through any channel.
  15. For third-party ad companies to show /display ads that may interest you. These companies may use information about your visits to Platform and Third-Party Platforms to show you ads for goods and services that may be of interest to you.
  16. Your data is shared with designated Professionals, Strategic Partners, our third party service providers and our affiliates. This data, which includes personal and financial information, will be utilized for share, host, use, copy, transmit, process, store, analyse, display, make derivations, and back up, you submit to us, through the Services and as required by us, including but not limited to personal data and any other data relating to financial information of yourself and others, for the purposes of (a) deliver the Services you have requested, as detailed in this Policy, and to facilitate your use of the Platform and Services, including those provided, by our Professionals, Strategic Partners, third parties, and affiliates; (b) enhance, develop, and safeguard the Services in order to create, market, or offer new services through the Company, or its Professionals, Strategic Partners, group companies and affiliates; (c) communicate with you regarding our Platform and Services; and sending you information we believe may be of interest to you.

You affirm and guarantee that you possess and will maintain all necessary rights to authorize the Company, its Professionals, Strategic Partners, third-party service providers, and affiliates to host, use, compile, copy, transmit, process, store, share, analyze, display, derive, and back up your data. This includes retaining aggregated customer data, which may be combined with data from other users.
  18. We reserve the right to conduct unannounced audits to detect and prevent fraud; monitor interactions and transactions to ensure service quality, compliance, and security; ensure compliance with protocols; combat fraud; verify your identity as required by law and best practices; analyse it to improve our services and enhance our operations; comply with the Information Technology Act, 2000. We may also retain/ store your data and confidential information, of any nature (either wholly or partially), in the Company’s arrangements servers or cloud or otherwise in any other medium as may be transmitted/ processed/ passed through the Platform and manage our infrastructure and commercial operations while adhering to our internal standards and procedures.
  19. Our platform features public blogs and forums, where any information you choose to share may be accessed and utilized by others, potentially leading to unsolicited communications. By participating in these public forums, you acknowledge that RUPYAFIN is not liable for any unauthorized use of your personal information. Additionally, please be aware that your posts and certain profile information may persist even after account termination. If you wish to request removal of your information from our blogs and forums, please submit your request to legal@rupyafin.com.
  20. By using our platform and services, you acknowledge, agree, and authorize us to collect, store, process, and transfer your information, including personal information, to third-party entities, including but not limited to:- Securities Exchange Board of India, National Stock Exchange of India Limited, Bombay Stock Exchange, Central Registry of Securitisation Asset Reconstruction and Security Interest of India (CERSAI), Payment gateways, Banks, KYC Registration Agencies, Asset Management Companies, Registrar and Transfer Agents, Mutual Funds, Income Tax Department. Please note that if you choose to utilize services provided by third-party service providers, your information may be subject to the privacy policies of such third parties, which may or may not be available. It is solely your responsibility to perform due diligence on such service providers and decide whether to proceed with their services. We will only share your personal data where our legitimate interests are not overridden by your interests.
  21. Professional Services (through Rupyafin) for availing services such as filing your ITR, GST and other listed products and services on our platform are provided by Independent Affiliates/ Professional including Professional Associate (provided to client login, under My Professional tab) through our Platform and Company is not liable for any obligation arising therefrom such services being rendered by Professional.
